First introduced in 1999, IR35 (Intermediaries Legislation) came into force in the 2000 Finance Act as a means to tackle the problem surrounding what HMRC deemed disguised employment. Unfortunately there were companies and contractors taking advantage of tax legislation at the time to avoid paying employers NI and avoiding employment benefits to workers who were treated the same as their employee counterparts.
In April 2021 the IR35 legislation underwent a change whereby in certain circumstances, the “End Client” or beneficiary of an intermediary worker is responsible for determining the employment status and must ensure the tax laws are followed correctly.
This led to mass panic in many sectors meaning End Clients blanketed all workers Inside IR35 without truly understanding the legislation.
